1. Agreement to Terms

Welcome to Templyd. By creating an account, accessing our platform, or using any of our services, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, you may not access or use Templyd. These Terms apply to all visitors, users, and account holders on our platform.

2. Description of Service

Templyd provides a hosted website builder and eCommerce platform, offering customizable templates, multi-store management, custom domain integration, SEO tools, analytics, and integrated payment processing through third-party gateways. All services are provided “as is” and may be updated or modified from time to time to improve performance and functionality.

3. Account & Eligibility

To use Templyd, you must be at least the age of majority in your jurisdiction and capable of forming a binding contract. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. If we believe your account is compromised, we reserve the right to suspend or terminate access to protect you and other users.

4. Acceptable Use Policy

You agree to use Templyd’s services only for lawful purposes. You may not use the platform to:

• Upload or distribute illegal, offensive, or defamatory content.
• Engage in spam, phishing, malware distribution, or hacking activities.
• Infringe on the intellectual property rights of others.
• Misuse our systems to cause harm or disrupt services for other users.

Violation of this policy may result in account suspension or permanent termination without refund.

5. Subscriptions & Billing

Templyd operates on a subscription-based model. All plans are billed in advance on a recurring basis, according to the plan selected during signup. Subscription fees are non-refundable except where required by law or explicitly stated in our Refund Policy.

• Automatic Renewal: Subscriptions renew automatically unless canceled before the renewal date.
• Payment Processing: All transactions are securely processed via third-party payment gateways such as Stripe.
• Upgrades/Downgrades: Plan changes take effect at the next billing cycle.
• Taxes: Users are responsible for all applicable taxes related to their subscription and sales made through Templyd.

6. Intellectual Property

All software, designs, trademarks, logos, templates, and documentation within the Templyd platform are owned or licensed by Templyd. Users retain ownership of the content they upload, but grant Templyd a limited license to host, display, and distribute that content solely for platform functionality.

You may not copy, resell, or redistribute Templyd templates or design assets outside of the platform.

7. Third-Party Services

Templyd integrates with third-party providers such as Stripe, Google Analytics, and others. Your use of these services is subject to their respective terms and privacy policies. Templyd is not responsible for downtime, errors, or issues caused by third-party integrations.

8. Data & Security

Templyd takes reasonable measures to protect user data through encryption, secure storage, and routine audits. However, no platform is completely immune to risks. Users are encouraged to maintain their own backups of critical content and data.

Templyd will not be liable for data loss resulting from user error, third-party attacks, or technical malfunctions beyond our control.

9. Cancellation & Termination

You may cancel your subscription at any time through your account dashboard. Your account will remain active until the end of the current billing period. Upon cancellation, you may lose access to premium features, templates, and stored content.

Templyd reserves the right to suspend or terminate any account that violates these Terms, poses a security risk, or causes disruption to the platform or other users.

10. Refund Policy

Due to the nature of digital services, refunds are generally not offered once a subscription has begun. Exceptions may apply if the service is unavailable due to technical failure directly attributable to Templyd. For more details, see our Refund Policy.

11. Limitation of Liability

Templyd, its affiliates, and partners are not liable for indirect, incidental, or consequential damages, including loss of revenue, data, or business opportunities. Our total liability under any claim shall not exceed the total amount paid by you to Templyd in the 12 months preceding the claim.

The platform and all services are provided “as is” without warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

12. Indemnification

You agree to indemnify and hold harmless Templyd, its affiliates, and staff from any claims, damages, losses, or legal fees arising from your violation of these Terms or your misuse of the platform.

13. Changes to These Terms

Templyd may modify these Terms & Conditions at any time. Updates will be posted on this page with a revised effective date. Continued use of the platform after such updates constitutes your acceptance of the new Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Alabama, United States, without regard to its conflict of law principles. Any disputes will be handled in the appropriate courts within that jurisdiction.
